Affiliate Terms of Use

As an authorized affiliate (“Affiliate”) of Europe Magic Wand, operated by Amok Products ApS (hereinafter, “the Company,” “we,” or “our”), you agree to abide by the terms and conditions contained in this Agreement (the “Agreement”). Please read the entire Agreement carefully before registering and promoting our products as an Affiliate.

By signing up for the Europe Magic Wand – Amok Products ApS Affiliate Program (the “Program”), you indicate your acceptance of this Agreement and its terms and conditions.

1. PROGRAM PARTICIPATION

Your participation in the Program is solely to legally advertise our website and products, to receive a commission on physical products purchased by individuals referred to us through your website, social media, or personal referrals.

2. APPLICATION APPROVAL OR REJECTION

We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

3. COMMISSIONS AND PAYMENTS

a) Commission Rate: Affiliates will receive a commission of 20% on the net sale price (after discounts, before taxes and shipping) of each Europe Magic Wand product sold through their affiliate link or coupon code.

b) Payout Schedule: Commissions will be paid once a month, within the first 10 business days of the following month, provided the minimum payout threshold has been reached. For an Affiliate to receive a commission, the referred transaction must remain active (no refund or chargeback) for a minimum of 31 days.

c) Payment Method: Payments will be made via bank transfer (SEPA) to European bank accounts. Before any payment is processed, the Affiliate must submit a valid invoice to Amok Products ApS for the commission amount specified by Amok Products ApS for that payment period. Payments will be made in Euros (EUR).

d) Minimum Payout Threshold: There is a minimum payout threshold of €200. If the Affiliate’s earned commissions do not reach this threshold by the end of a calendar month, the balance will roll over to the following month(s) until the threshold is met.

e) Invoice Requirements: To receive payment, the Affiliate must provide:

A valid invoice issued to Amok Products ApS, Smidstrupvej 116, 3250 Gilleleje, Denmark, VAT number: DK33260369.
The invoice must include the Affiliate’s full legal name (or company name), address, and VAT number (if applicable).
The invoice amount must match the commission total specified by Amok Products ApS for the payment period.
Invoices must be submitted to affiliate@europemagicwand.com after receiving the commission statement from Amok Products ApS.

Failure to provide a valid invoice within the specified timeframe may result in delayed or forfeited payment.

f) Self-Referrals: You cannot refer yourself, and you will not receive a commission on your own purchases.

4. TAX OBLIGATIONS

a) Affiliate Tax Responsibility: The Affiliate is solely responsible for complying with all applicable tax obligations in their country of residence, including but not limited to:

- Registration with the relevant tax authority in their country of residence.

- Issuance of valid invoices for income received, as required under applicable tax law.

- Declaration and payment of income tax and Value Added Tax (VAT) as applicable.

b) Tax Withholding: The Company will not withhold taxes from commission payments, unless expressly required by applicable law. It is the sole responsibility of the Affiliate to declare and pay their taxes.

c) Invoicing: The Affiliate must provide a valid invoice for commission payments received. The invoice must include the Affiliate’s full legal name or company name, address, and VAT number (if VAT-registered). The Company will request an invoice from the Affiliate for promotional services rendered.

d) VAT (EU Affiliates): If the Affiliate is VAT-registered in an EU member state other than Denmark, the reverse charge mechanism may apply. The Affiliate is responsible for correctly applying VAT rules under the EU VAT Directive. Non-EU Affiliates are responsible for complying with the tax laws of their country of residence.

5. TERMINATION

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

- Inappropriate advertisements (false claims, misleading hyperlinks, etc.).

- Spamming (mass email, mass newsgroup posting, etc.).

- Advertising on sites containing or promoting illegal activities.

- Failure to comply with EU consumer protection laws, including the Unfair Commercial Practices Directive (2005/29/EC), or applicable national consumer protection regulations.

- Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under applicable EU and national advertising laws, including the EU Unfair Commercial Practices Directive.

- Violation of intellectual property rights. Europe Magic Wand – Amok Products ApS reserves the right to require license agreements from those who employ trademarks of Europe Magic Wand – Amok Products ApS in order to protect our intellectual property rights.

- Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with Europe Magic Wand – Amok Products ApS, however, is acceptable.

- Self-referrals, fraudulent transactions, suspected Affiliate fraud.

In addition to the foregoing, Europe Magic Wand – Amok Products ApS reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or for no reason.

6. AFFILIATE LINKS AND MATERIALS

You may use graphic and text links both on your website and within your email messages. You may also advertise the Europe Magic Wand site in online and offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section.

Disclosure Requirements: The Affiliate MUST clearly disclose their affiliate relationship in all promotions (website, social media, email, etc.) using clear language such as: “This is an affiliate link. I may receive a commission if you make a purchase.” or “Paid advertisement” / “Commercial collaboration.”

7. COUPON AND DEAL SITES

Europe Magic Wand – Amok Products ApS occasionally offers coupons to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

- Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.

- Affiliates may not bid on “Europe Magic Wand Coupons,” “Europe Magic Wand Discounts,” or other phrases implying coupons are available.

- Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.

- The User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e., “click here to see coupons and open a window to merchant site” is NOT allowed).

- Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.

8. PAY PER CLICK (PPC) POLICY

PPC bidding is NOT allowed using our trademarks, product names, or variations thereof without prior written permission. This includes, but is not limited to, platforms like Google Ads, Facebook Ads, and similar advertising networks.

9. PERMITTED PRODUCTS AND RESTRICTIONS

a) Covered Products: This Program exclusively covers Europe Magic Wand products sold through our official website: europemagicwand.com.

b) Prohibited Claims: The Affiliate MAY NOT make unauthorized medical, therapeutic, or health claims about the products, including but not limited to:

- Claiming the product cures, treats, or prevents diseases.

- Making comparisons to regulated medical devices.

- Using false or unverifiable testimonials.

c) Regulatory Compliance: The Affiliate must ensure that all advertising complies with applicable EU regulations, including the EU General Product Safety Regulation and any relevant national regulations in the markets where they advertise.

10. DATA PROTECTION

a) GDPR Compliance: Both the Company and the Affiliate shall comply with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and any applicable national data protection laws when processing personal data in connection with the Program.

b) Affiliate Obligations: The Affiliate shall ensure that any personal data collected or processed in connection with promotional activities (e.g., email marketing, website tracking) is handled in full compliance with the GDPR, including obtaining valid consent where required.

c) Cookie Consent: The Affiliate must ensure that affiliate cookies are only set in compliance with the ePrivacy Directive (2002/58/EC) and applicable national cookie consent laws, including obtaining prior informed consent from end users where required.

11. LIABILITY

Europe Magic Wand – Amok Products ApS will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/or the products sold by Europe Magic Wand – Amok Products ApS. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

12. TERM OF THE AGREEMENT

The term of this Agreement begins upon your acceptance into the Program and will end when your Affiliate account is terminated.

The terms and conditions of this Agreement may be modified by us at any time. We will notify you of material changes by email at least 15 days in advance. If any modification to the terms and conditions of this Agreement is unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

13. INDEMNIFICATION

Affiliate shall indemnify and hold harmless Europe Magic Wand – Amok Products ApS and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Europe Magic Wand – Amok Products ApS to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

14. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of Denmark. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the competent courts of Hillerød, Denmark.

15. ELECTRONIC SIGNATURES

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Europe Magic Wand – Amok Products ApS affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Europe Magic Wand – Amok Products ApS application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature, in accordance with the EU eIDAS Regulation (EU) No 910/2014 on electronic identification and trust services.
